Let us preface this by saying that filing a lawsuit should only be done when you have exhausted all other means of resolving your legal issue – especially when it comes to family, friends, and business associates.
Assuming this has been done we advise you to follow these basic steps for filing a lawsuit:
- If you have already signed any documents or received any compensation you should thoroughly look over the documents and become as familiar with them as possible. (this can help reduce billable hours with your lawyer). Often if you have already accepted any form of compensation you will not be able to sue. However, you should contact a lawyer to be sure.
- You may want to consult a mediator that can talk between your and the other party or parties. This may cost less money and avoid the legal system all together.
- If the mediation is not an option or has failed then you should consult a lawyer! If you can not afford one you can try looking at Legal Aid. Some lawyers will take cases pro bono – you never know, so ask!
- If you do not wish to hire an attorney you may file a lawsuit by yourself – known as pro-se. Use the search function above to find out more information about this.
- Small claims court (under $5000) are often handled in the pro-se fashion.
- If you hire a lawyer they will help you file the lawsuit, just be certain that it is still with the statute of limitations.
- Do not wait! If you wait too long then the statute of limitations may expire and you will no longer be able to file your lawsuit!
